In an amicus brief to 303 Creative v. Elenis, the Jewish Reform Movement argued alongside 30+ religious, civil rights, and grassroots groups that nondiscrimination laws must carefully balance civil rights and religious freedom. The recent U.S. Supreme Court’s decisions undermine this critical balance. We will discuss how the creation of a broad new free speech exemption for businesses, as well as recent state legislative restrictions, opens the door not only to further discrimination against LGBTQ+ people but also to discrimination against religious minorities and other marginalized groups and what we can do to combat this hate and overcome this division.
